Warranty and Return Policy

This website available at https://smartharvest.ca is operated by Smart Harvest Instruments Inc. Throughout the site, the terms “we”, “us” and “our” refer to Smart Harvest Instruments Inc.

This Warranty and Return Policy applies if you make a purchase of a product available on the Website.

SECTION 1 – Return Policy

We have a 30-day return policy, which means you have 30 days after receiving your item to request a return.

To be eligible for a return, the following conditions apply:

  • Your item must be in the same condition that you received it: new, unopened in its original packaging, all applicable tags and seals intact, and not used. For Hotspot products, this means the Hotspot is not onboarded or attached to a wallet.
  • You have a valid receipt or proof of purchase.
  • You have a valid return authorization from our customer service team

If your return is accepted, we’ll send you instructions on how and where to send your package. 

Items sent back to us without first requesting a return will not be accepted.

Please note that if your country of residence is not Canada, shipping your goods may take longer than expected.

SECTION 2 – Refunds

Once your returned item is received, it will be inspected. Returns will not be approved under the following conditions:

  • Item was shipped to us without a valid return authorization or is missing the return authorization number
  • Item is returned opened and used. For Hotspot Products, this may mean the Hotspot is onboarded and/or attached to a wallet.
  • Item is returned without all parts and accessories originally included
  • Item is physically broken or damaged

We will notify you once we’ve received and inspected your return to let you know if the refund was approved or not.

If approved, you’ll be automatically refunded on your original payment method within 10 business days. Please remember it can take some time for your bank or credit card company to process and post the refund too.

Shipping costs are non-refundable.

If not approved, we retain the right to either refuse acceptance of the return or charge you a restocking fee of 15% of the original price of the Product(s) or the retail value of the missing parts and accessories, whichever is higher.

SECTION 3 – Damages and Issues

Please inspect your order upon receipt and contact us immediately if the item is defective, damaged, or if you receive the wrong item, so that we may evaluate the issue and make it right. Please get in touch if you have questions or concerns about your specific item.

Unfortunately, we cannot accept returns on sale items or gift cards.

SECTION 4 – Exchanges

The fastest way to ensure you get what you want is to return the item you have, and once the return is accepted, make a separate purchase for the new item.

SECTION 5 – Limited Product Warranty

Hardware Product(s) come with a limited warranty that is valid for 12 months from the Product purchase date. The Limited Product Warranty applies if a Product is defective in materials or workmanship (due to our fault) when used normally and within our published guidelines, which include but are not limited to User Manuals, online technical specifications, and service communications.

If a Product’s defects are found to be covered by the Limited Product Warranty we will, at our option, replace or refund the Product.

If you wish to apply the Limited Product Warranty, please contact us at hello@smartharvest.ca with your proof of purchase and the details on the reason of the warranty request.

SECTION 6 – Limited Product Warranty Exclusions and Limitations

We do not warrant that the operation of the Product will be uninterrupted or error-free. The Limited Product Warranty does not cover software embedded in any Product and related services provided by us, if any.

The Limited Product Warranty only applies to the original purchaser of the Product that was purchased from this Website, other Smart Harvest Instruments Inc official stores, or resellers expressly authorized by Smart Harvest Instruments Inc.

Without limiting the foregoing, the Limited Product Warranty does not apply: (a) to consumable parts (such as batteries); (b) any third-party products, even if packaged or sold with our Product(s); (c) cosmetic damage, including but not limited to scratches and dents; (d) Products that were misused or operated outside the permitted or intended uses as defined by our guidelines (including but not limited to use with improper voltage or power supplies and use not in accordance with the appropriate instructions); (e) accident, abuse, liquid contact, fire, or other external causes; (f) to Products that have been serviced, altered, disassembled (including but not limited to opening a Product’s enclosure), or otherwise modified by any party not explicitly authorized by us in writing; (g) to software, even if packaged or sold with the Product or embedded in the Product; (h) to Products with software that has modified without our explicit written consent, including but not limited to installation of third-party software; (i) to damage caused by normal wear and tear or otherwise normal aging of the Product; (j) Products that are, or we reasonably believe to be, stolen; (k) Products with missing unique identifier (UID) labels; or (l) Products that are properly functioning, for Hotspot Products this includes Hotspots that are operational but not receiving mining rewards or receiving less mining rewards than expected due to circumstances outside of our control (including but not limited to hotspot location, hotspot placement, and density of other hotspots in location).

SECTION 7 – Implied Warranties

Except to the extent prohibited by applicable law, the Limited Product Warranty shall be in lieu of the implied warranties.

SECTION 8 – Limitation of Damages

Except to the extent prohibited by applicable law, we shall not be liable for any incidental, indirect, special, or consequential damages, including, without limitation, loss of profits, revenue or data, resulting from any breach of express or implied warranty or condition or under any other legal theory, even if we have been advised of the possibility of such damages.

SECTION 9 – Changes

We may update this Policy from time to time in order to reflect, for example, changes to our practices or for other operational, legal or regulatory reasons.
